The Minister of Finance has signed Decision No. 1859/QD-BTC publishing 25 legal documents on business conditions which are no longer effective in terms of the Ministry of Finance’s State management.
Accordingly, the Ministry of Finance superseded several articles and items of 7 legal documents in Customs such as Decree No. 08//2015/NĐ-CP detailing the implementation of the Law on Customs in terms of Customs procedures and Customs supervision; Decision No. 24/2009 /QĐ-TTg stipulating duty free goods business; Decision No. 44/2013/QĐ-TTg amending certain articles of Decision No. 24; Circular No. 38/2015/TT-BTC regulating Customs procedures, Customs supervision, import and export duties and tax management for imports and exports; Circular No. 191/2015/TT-BTC on Customs procedures for imports and exports, transited goods sent by international express companies, and Circular No. 49/2015/TT-BTC on Customs procedures for postal parcels, packages sent by designated post.
Abolished contents have been replaced with regulations of Decree No. 68/2016/NĐ-CP on the conditions for duty free goods business, warehouses, sites, Customs transaction places, consolidation of goods, Customs control and supervision which has been issued and taken effect from July 1st, 2016.
Besides, the Ministry of Finance superseded several articles of Circular No.183/2013/TT-BTC on independent audit in the units of public interests; the Circular No. 124/2012/TT-BTC guiding the implementation of Decree No. 45/2007/NĐ-CP by the Government which gives guidelines to carry out the Law on Insurance Business; Circular No.125/2012/TT-BTC guiding financial mechanisms for insurance businesses, re-insurance businesses, insurance agents and international life insurance businesses.
In insurance, the Ministry of Finance has annulled 16 contents of Circular No. 194 /2014/TT-BTC amending the two above mentioned circulars No. 124 and 125; abolishing 02 articles of Circular No. 135 /2012/TT-BTC guiding the implementation of joint insurance products; 02 articles of Circular No. 115/2013/TT-BTC guiding the implementation of retirement insurance and voluntary retirement funds; 01 article of Circular No 130/2015/TT-BTC amending and supplementing Circular No. 115; 02 articles of Circular No. 52/2016/TT-BTC guiding the implementation of joint insurance products.
The Ministry of Finance has also abolished Article 6 of Circular No. 117/2012/TT-BTC guiding the performance of tax formalities related service.
At the same time, in securities, all the contents amended in Decree No. 86/2016/NĐ-CP by the Government regarding securities investment and business conditions have been annulled by the Ministry of Finance.
All the contents annulled in Decision No.1859/QĐ-BTC are no longer effective and are replaced from July 1st 2016.
