Ministry issues circular to provide guidance on implementation of trade remedies in RCEP

The Ministry of Industry and Trade (MoIT) has issued Circular No. 07/2022/TT-BCT on guiding the implementation of trade remedies in the Regional Comprehensive Economic Partnership (RCEP).

According to the Circular, the investigating authority is obliged to notify in writing the member country subject to investigation of the receipt of the application for anti-dumping investigation at least seven days before the MoIT decides to investigate the application of anti-dumping measures.

The investigating authority is obliged to notify in writing the member country under investigation of the receipt of the dossier of request for anti-subsidy investigation at least 20 days before the MoIT decides to investigate the application of anti-subsidy measures.

Upon request from the government of the member state concerned, the investigating authority is obliged to provide a non-confidential copy of the anti-subsidy investigation request file.

Regarding the method of the calculation of the dumping margin: When calculating the dumping margin according to the provisions of Decree No.10/2018/ND-CP, the investigating authority must calculate all the individual margins, even though positive or negative results, on the general margin of each foreign producer or exporter. The Circular will take effect from May 8, 2022.
